Welcome to www.pacificdesignerhomes.com.au (this website). This website is owned and operated by Pacific Designer Homes Pty Ltd ACN 055 718 048 ~ NSW BLN 137828C. We reserve the right to amend these terms and conditions from time to time. Amendments will be effective immediately upon notification in this website. Your continued use of the website following such notification will represent an agreement by you to be bound by the terms and conditions as amended. Please note that the information contained on this website is subject to change at any time without notice. The information contained on this website is governed by the laws of the State of NSW, Australia and by accessing the material on this website you agree to be bound by these terms of use. However, Pacific Designer Homes reserves the right to review materials posted to a Communication Service and to remove any material/s in its sole discretion. Intellectual Property Policy

As a matter of law, all plans, designs, illustrations, photos, images or other similar material produced by Pacific Designer Homes, whether in printed form or represented in actual homes are owned by Pacific Designer Homes. It is a breach of Pacific Designer Homes copyright for anyone to use these, whether in whole or in part, unless expressly authorised by Pacific Designer Homes. The most common way we authorise people to use our intellectual property is through signing a building contract with Pacific Designer Homes. In the event that we detect or are informed of any breach of Pacific Designer Homes intellectual property rights, we will pursue legal avenues to protect Pacific Designer Homes and its customers. We have enforced these rights on a number of occasions and the remedy awarded can be for damages to be paid and these sums can be substantial. If you would like further information on our policy, please contact pacificdesignerhomes@bigpond.com  and note subject matter on email to be INTELLECTUAL PROPERTY ISSUE and a Pacific Designer Homes representative will contact you. Should you believe Pacific Designer Homes rights have been infringed, we also encourage you to advise us. To this end, should we successfully pursue the matter, there is a $400 reward that applies. Concerning information on how it is presented in sentence structure on this website; no intellectual property policy applies to Pacific Designer Homes Pty Ltd.

Fixed Price Guarantee Terms and Conditions

The Fixed Price Guarantee applies to Contracts entered into by Pacific Designer Homes Pty Ltd (ACN 055 718 048) NSW OFT 137828C (Pacific Designer Homes, our, us), subject to the terms and conditions set out in this document (Terms and Conditions).

Our Fixed Price Guarantee is intended to help you build a new home by providing certainty. Before commencing construction, Pacific Designer Homes will specify in your Contract a fixed price for the building and site works specified in the Contract. This provides you with the knowledge that there are no hidden unknown extra costs. Prior to construction, we will agree with you a fixed price in respect of the costs of construction of your house and associated site works in accordance with the specifications of your Contract. 

For the purposes of these Terms and Conditions: 

(a) Site Works means costs of the minimum site works for compliance with building and statutory requirements which are associated with labour, material, plant hire, sewerage connection, rock excavation (where rock is evident in the soil test borelogs we will allow an Provisional Sum allowance for rock removal and the cost is unknown at that stage and is adjustable against actual cost when established), stormwater connection, water connection, additional known engineering requirements (apart from extra costs associated with raising building platforms/floor levels or the engineer deems areas of house is founded on soft spots that was previously unknown at soil test stage) and electricity/telecommunication connection from the date of construction; and 

(b) Mandatory Items includes in respect of the site, the registered plan, contour survey, soil test, supervisor site inspection including public risk assessment, natural gas form, location of water service connection point, recycled water availability including location of connection point, telecommunication service information including location of connection point, sewer information including “as constructed” stormwater plans clearly indicating all dimensions of mains from boundaries and surface levels/invert levels of both the mains and the house connections points, stormwater information including “as constructed” stormwater plans clearly indicating all dimensions of mains from boundaries and surface levels/invert levels of both the mains and the house connection points, preliminary town planning assessment and covenant requirements and any other information as we may reasonably require. 

(c) Contract refers to your New Home Construction Contract, New Home Tender and any Post Contract Variations signed prior to the commencement of the construction of your house.

(d) Some allowances allowed for on Lifestyle Inclusions list that may not be a predetermined rates and as such are an allowance only (including; but not limited to such as council fees, brick allowance, ceramic tile allowance, scaffold, height allowance, etc) and are adjusted against actual cost as per terms of contract with difference paytable by the client.

 2. Subject to clause 3 of these Terms and Conditions, Pacific Designer Homes represents and warrants that the costs of construction of the house and Site Works in accordance with the specification set out in the Contract will be for a fixed amount as specified in the Contract (Fixed Price Guarantee).  

3. The Fixed Price Guarantee does not apply to preliminary contracts entered into before you provide the Mandatory Items to us. 

4. You must promptly provide to us all required information and Mandatory Items in order for Pacific Designer Homes to provide you with a Fixed Price Guarantee.  

5. These Terms and Conditions shall be governed in accordance with the law of the State in which your home is being constructed or is to be constructed. You submit to the non-exclusive jurisdiction of the courts in that State. 

6. To the extent of any inconsistencies between these Terms and Conditions and your Contract, the Contract shall prevail. 

7. You are not entitled to rely on the words or conduct of Pacific Designer Homes as a waiver of any right pursuant to these Terms and Conditions unless that waiver is in writing and signed by an authorised representative of Pacific Designer Homes.  

8. Pacific Designer Homes reserves the right to vary, terminate or suspend the operation of the Fixed Price Guarantee offer in its absolute discretion, without notice, at any time provided that such variation, termination or suspension shall have no effect on existing building contracts at such time.   

House Prices

  • Advertised prices include GST
  • Advertised prices for house plans only are based on the standard house plan, included facade option if noted (where not noted it is hip roof as per inclusions list) and Pacific Designer Homes' preferred siting on the block of land
  • Price may increase if changes are made to the standard house plan and facade option
  • Land costs & associated legals/conveyancing, etc, site costs, developer guideline and estate covenant costs, Bushfire Attack Level costs, local council building costs over and above allowance as per inclusions list, stamp duty, legal fees and other costs to be charged to the client are not included in the advertised house only prices. Refer to inclusions list for what is included

  • Geographical restrictions apply and travel area surcharges may be applicable depending on building location (refer home price list or enquire with your sales representative) 
  • Cash buyers need to enter into a Joint Signatory bank account relating to transactions contained within building contract
  • House plans are given as an example and may not meet individual council criteria as it may vary from council to council (consult your sales representative)

Non-Fixed Price House & Land Conditions

  • All images and illustrations are to be used as a guide only and may represent non-standard or upgrade options that are not included in the package price
  • Land not supplied by Pacific Designer Homes, land developer terms and conditions apply
  • House and Land packages are only available for the specific lot and home advertised
  • Some House and Land Packages will have allowances (this will be nominated as a $ amount) within the builder's price for Site Costs for slab which are determined upon receipt of Soil Test & Foundation Slab Design
  • Some House and Land Packages will have allowances (this will be nominated as a $ amount) in it such as Value allowance for Land  
  • Packages do not cover site costs incurred for rock found on any lots advertised in the campaign
  • The determined house siting on the lot is at the sole discretion of Pacific Designer Homes only
  • Packages may change as a result of variations to the inclusions or specifications required by the purchaser, local authority, or local, state or federal law
  • Packages do not include stamp duty, legal fees or any other costs incurred with the purchase
  • Unless otherwise noted, packages do not cover any bushfire, acoustic or N3 requirements
  • House and Land packages require an application for covenant and council approval and are therefore subject to approval prior to entering into a contract with Pacific Designer Homes
  • Pacific Designer Homes is responsible for the contract of the sale of the home only
  • Customers will be required to enter into a separate contract for the land component of the package with the relevant land developer
  • House and land packages are only available to customers who make a deposit before or on the advertised timeframe, or at the discretion of Pacific Designer Homes, and who enter into a final home building contract with Pacific Designer Homes before or on the advertised timeframe, or at the sole discretion of Pacific Designer Homes
  • Final costs, dimensions and inclusions may vary from the information provided and may be varied by Pacific Designer Homes without notice
  • Pacific Designer Homes reserves the right to withdraw any House & Land Package at any time without notice
  • Pacific Designer Homes reserves the right to withdraw any House & Land Package if the land or home become unavailable or sold
  • Cash buyers need to enter into a Joint Signatory bank account relating to transactions contained within the building contract
  • House plans are given as an example and may not meet individual council criteria as it may vary from council to council (consult your sales representative) 

 Fixed Price House & Land Conditions

  • All images and illustrations are to be used as a guide only and may represent non-standard or upgrade options that are not included in the package price
  • Land not supplied by Pacific Designer Homes, land developer terms and conditions apply
  • House and Land packages are only available for the specific lot and home where advertised
  • The determined house siting on the lot is at the sole discretion of Pacific Designer Homes only
  • Packages may change as a result of variations to the inclusions or specifications required by the purchaser
  • Packages do not include stamp duty, legal fees or any other costs incurred with the purchase
  • Unless otherwise noted, packages do not cover any bushfire, acoustic or N3 requirements

General Limitations to all House & Land Packages

  • All House and Land packages are not eligible to apply for advertised promotions where a home is purchased outside of any package arrangement
